за установяване на определени защитни мерки с оглед на предотвратяване на разпространението на чумата по дребните преживни животни в България

ЕВРОПЕЙСКАТА КОМИСИЯ,
като взе предвид Договора за функционирането на Европейския съюз,
като взе предвид Директива 89/662/ЕИО на Съвета от 11 декември 1989 г. относно ветеринарните проверки по отношение на търговията вътре в Общността с оглед доизграждането на вътрешния пазар (1) , и по-специално член 9, параграф 4 от нея,
като взе предвид Директива 90/425/ЕИО на Съвета от 26 юни 1990 г. относно ветеринарните и зоотехническите проверки, приложими при търговията в Общността с определени видове живи животни и продукти с оглед завършване изграждането на вътрешния пазар (2) , и по-специално член 10, параграф 4 от нея,
като има предвид, че:

Чумата по дребните преживни животни (ЧДПЖ) е тежко вирусно заболяване на дребните преживни животни, а именно овцете и козите, което се предава основно чрез пряк контакт. Заболеваемостта и смъртността поради ЧДПЖ могат да са много високи, особено в райони, където ЧДПЖ се наблюдава за първи път, и тя може да има сериозни икономически последици за земеделския отрасъл. ЧДПЖ не се предава на човека. ЧДПЖ е ендемична в много държави в Африка, Близкия изток и Азия и поражда сериозни опасения за здравето на животните и хуманното отношение към тях.

В Директива 92/119/ЕИО на Съвета (3) се определят общи мерки за борба с някои болести по животните, включително ЧДПЖ. Сред тях са мерки за борба, които трябва да бъдат предприети при съмнение и потвърждение на наличието на ЧДПЖ в стопанство. Тези мерки за борба включват също така създаването на предпазни и надзорни зони около огнищата и други допълнителни мерки за борба с разпространението на това заболяване.

На 23 юни 2018 г. България нотифицира Комисията и останалите държави членки за едно огнище на ЧДПЖ в три стопанства за дребни преживни животни, където животните пасат заедно в община Болярово, област Ямбол в България.

България предприе мерките за борба, предвидени в Директива 92/119/ЕИО, и по-специално унищожаването на заразените стада и създаването на предпазни и надзорни зони около огнищата, както е предвидено в посочената директива. Надзорът беше също така засилен в общините в съседство със засегнатите зони, както и в общините, разположени по границата на Съюза с трети държави, които не са свободни от ЧДПЖ.

В допълнение към мерките за борба, предвидени в Директива 92/119/ЕИО, е необходимо да се предприемат допълнителни защитни мерки, за да се предотврати разпространението на ЧДПЖ. Съответно, за да се предотврати разпространението на ЧДПЖ към други райони на България, към други държави членки и към трети държави, особено чрез търговия с дребни преживни животни и зародишни продукти от тях, следва да се контролират изпращането на пратки с дребни преживни животни и пускането на пазара на определени продукти, получени от дребни преживни животни.

Решение за изпълнение (ЕС) 2018/911 на Комисията (4) беше прието, за да се предотврати разпространението на ЧДПЖ към други части на България, към други държави членки и към трети държави. В посочения акт са предвидени временни защитни мерки, и по-специално забрана на изпращането на пратки с дребни преживни животни и пускането на пазара на определени продукти, получени от дребни преживни животни от област Ямбол в България.

След датата на приемане на Решение за изпълнение (ЕС) 2018/911 България нотифицира Комисията за ново огнище на ЧДПЖ на територията си — в стопанство за дребни преживни животни в област Бургас.

Също така България нотифицира Комисията, че след появата на посоченото ново огнище е предприела необходимите мерки, изисквани по силата на Директива 92/119/ЕИО, включително създаването на предпазни и надзорни зони около стопанството със заразени животни на територията си.
(9)
Защитните мерки, предвидени в настоящото решение, следва да отчитат актуалната епидемиологична ситуация в България и да заменят временните защитни мерки по Решение за изпълнение (ЕС) 2018/911. Поради това посоченото решение следва да бъде отменено.

Мерките, предвидени в настоящото решение, са в съответствие със становището на Постоянния комитет по растенията, животните, храните и фуражите,
ПРИЕ НАСТОЯЩОТО РЕШЕНИЕ:
Член 1
С настоящото решение се установяват определени защитни мерки с оглед на предотвратяване на разпространението на чумата по дребните преживни животни в Съюза.
То се прилага към дребните преживни животни, семенната течност, яйцеклетките и ембрионите от тези животни, както и към определени стоки от тях.
Член 2
За целите на настоящото решение се прилагат следните определения:
a)
„дребни преживни животни“ са животни от рода на овцете и козите;
б)
„странични животински продукти“ са странични животински продукти, както са определени в член 3, точка 1 от Регламент (ЕО) № 1069/2009 на Европейския парламент и на Съвета (5);
в)
„производни продукти“ са производни продукти, както са определени в член 3, точка 2 от Регламент (ЕО) № 1069/2009.
Освен това се прилагат определенията от приложение I към Регламент (ЕО) № 853/2004 на Европейския парламент и на Съвета (6).
Член 3
България забранява изпращането от районите, посочени в приложението, до други части на България, до други държави членки и до трети държави на следните стоки:
a)
дребни преживни животни;
б)
семенна течност, яйцеклетки и ембриони от дребни преживни животни.
Член 4
1. България забранява пускането на пазара на следните стоки извън районите, посочени в приложението, когато тези стоки са произведени от дребни преживни животни, произхождащи от посочените в приложението райони:
a)
прясно месо;
б)
мляно месо и месни заготовки, произведени от месото по буква а);
в)
месни продукти и обработени стомаси, пикочни мехури и черва за консумация от човека, произведени от месото по буква а), различни от тези, които са преминали обработка за елиминиране на някои ветеринарно-санитарни рискове съгласно приложение III към Директива 2002/99/ЕО на Съвета (7);
г)
сурово мляко и млечни продукти, различни от тези, които са преминали обработка в херметически запечатани контейнери при стойност на F0 3,00 или повече, както е описано в приложение III към Директива 2002/99/EО;
д)
продукти, съдържащи стоките по букви а) — г);
е)
странични животински продукти.
2. Чрез дерогация от забраната по параграф 1, буква е) от настоящия член компетентният орган може да разрешава изпращането на странични животински продукти под официален надзор, предназначени за преработване в производни продукти или унищожаване в одобрено предприятие на територията на България в съответствие с правилата по член 4, параграф 4 от Регламент (ЕО) № 1069/2009.
Член 5
Решение за изпълнение (ЕС) 2018/911 се отменя.
Член 6
Настоящото решение се прилага до 28 декември 2018 г.
Член 7
Адресат на настоящото решение е Република България.
